The Global Flag Contest - Rules and Regulations

1. THE CONTEST: The Power of Peace Global Flag Contest (the “Contest”) gives you the opportunity to design and submit a global flag that stands for peace, global patriotism, hope without borders and respect for diversity. Together we will vote on the submissions, select a winning global flag and fly it in houses, buildings and cities around the world.

2. ELIGIBILITY: Submissions may be made by an individual, or on behalf of a group of individuals or non-professional organization (e.g., a third-grade class, a Boy Scout troop). For-profit corporations, partnerships or other similar companies are not permitted to enter.
Only one submission per individual or group is permitted – so give us your best! Employees, officers and directors of The Power of Peace LLC (“The Power of Peace”) are not eligible.

3. AGREEMENT: By participating in the Contest, you accept and agree to these Rules and Regulations and the decisions of The Power of Peace, which are final on all matters pertaining to this Contest. Additionally, if you have not reached the age of majority in your state of residence (a “Minor”), your parent or legal guardian (“Parent”) accepts and agrees to these Rules and Regulations on your behalf. Further, your Parent shall sign any documents required for you to participate in the Contest.

4. SUBMISSIONS: You may enter the Contest at any time until June 30, 2010 at 11:59 pm EST (the “Entry Period”). To enter, you must (1) create an original global flag design in any two dimensional medium (the “Flag Design”), (2) complete the Official Contest Entry Form, and (3) submit the Flag Design and Official Entry Form (together, the “Submission”) to The Power of Peace during the Entry Period by mail, email or online submission here. To submit your Submission by mail, please send it to Power of Peace Global Flag Contest, c/o The Power of Peace, PO Box 413, Craryville, NY 12521. To submit your Submission by e-mail, please scan the Flag Design and Official Entry Form, save them as JPG or PDF files, attach them to your e-mail and send your e-mail to: globalflag@thepowerofpeace.com. If you are a minor, your Parent must sign and submit the Submission on your behalf. Submissions with incomplete Official Contest Entry Forms may be disqualified.

5. JUDGING: Each Submission will be automatically entered into one of two categories based on the age of the participant: (1) Category A (16 years of age and below); or (2) Category B (above 16 years of age). Submissions entered by groups of individuals or non-professional organizations with members who are both over and under 16 will be automatically entered into Category B.

In Phase One of the judging process, the public will be invited to vote for the five (5) finalists for each Category. Only registered members of The Power of Peace will be eligible to cast votes.

In Phase Two, a panel of judges selected by The Power of Peace will select the Contest winner from the ten (10) finalists.

All finalists and the Contest winner will be announced by the Power of Peace at a to-be-determined date and place.

The Category finalists will be notified within approximately fourteen (14) days after the Entry Period expires. The winner of the contest will be notified approximately thirty (30) days after the Category finalists have been announced.

If the Power of Peace is unable to contact the potential winner after reasonable effort, or if the potential winner fails to respond within seven (7) days of first attempted notification, the award may be forfeited and an alternate winner selected. The winner may be required to execute and return additional releases or documentation deemed necessary or appropriate by the Power of Peace, including without limitation, an affidavit of eligibility, liability release, publicity release and copyright assignment. Such additional documentation shall be executed and returned to the Power of Peace within seven (7) days following the date of first attempted notification. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any award notification as undeliverable may result in disqualification and selection of an alternate winner.

The Power of Peace reserves the right not to award a winner if, in its sole discretion, no Submission meets its requirements, standards or expectations or if it does not receive a sufficient number of eligible Submissions.

6. SUBMISSION REQUIREMENTS: The participant represents, warrants and covenants that the Submission is the original creation of the participant and does not contain any artwork, designs, logos, images, text or other material that are protected under applicable copyright, trademark, patent or other intellectual property laws and owned by any person or entity other than the participant. The participant further represents, warrants and covenants that the Submission does not include inappropriate or unlawful content, including content that (1) is vulgar, obscene, pornographic, violent or defamatory; (2) invades the privacy or publicity rights of any person; or (3) infringes the intellectual property rights or other proprietary rights of any person or entity. Use of any material in violation of this section may result in disqualification of a Submission in The Power of Peace’s sole discretion.

7. RIGHTS TO SUBMISSIONS: All Submissions become the property of The Power of Peace and cannot be returned. You grant to The Power of Peace an unlimited, perpetual, worldwide, royalty-free, fully paid-up, right and license to copy, publicly display, publicly perform, broadcast, transmit, modify, distribute, publish, create derivative works based on and otherwise use the Submissions, in whole or in part, for any lawful purpose, including without limitation in connection with: telecasts, videotapes, DVDs, the Internet, exhibits, books, pamphlets, and any other publication or media now know or hereafter created; supplemental presentations to educational institutions, trade groups, advertising professionals and the public generally; award shows; Power of Peace sponsored or produced events; or in any other public or private presentation with or without charge whenever and as often as the organizers see fit without compensation to Participant. Further, you agree that upon request by The Power of Peace, you will sign a copyright assignment to your Submission. Entrant authorizes Power of Peace the use for such purpose of any trademark, animated character(s), animal(s), and merchandised item(s) included in the Submission. Power of Peace may charge a fee to third parties for use of such material without compensation to participant. The Power of Peace shall have no obligation to use any Submissions, in whole or in part, or to exploit the licenses granted herein. Entrant holds or will secure the necessary license for use of all copyrighted elements embodied within the entries. Entrant will fully defend, indemnify and hold Power of Peace, its affiliated companies, assignees and licensees harmless from any talent or other residual charges due to the release of selected entries or any third party claims against Power of Peace, its affiliated companies, assignees and licensees resulting from the content of the entries and the intellectual property contained therein. The person submitting this entry form(s) certifies that he or she has full authority to approve the rights granted herein.

8. PUBLICITY: Unless prohibited by law, participant grants to The Power of Peace the right to use and publish participant’s proper name, likeness, picture, and biographical information online, in print and in any other media in connection with the Contest, without compensation. Participant will not have, and hereby waives any, claims arising from use of such information, in whole or in part, by The Power of Peace, including claims for payment or claims based on invasion of privacy, defamation, or right of publicity.

9. LIMITATION OF LIABILITY; RELEASE; INDEMNIFICATION: Participant agrees to release and hold harmless The Power of Peace, its parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with participation in this Contest. Participant shall indemnify, defend and hold harmless the Power of Peace, its parents, subsidiaries, affiliates, directors, officers, employees and agents from any loss, liability, cost, expense, claim or damage (including reasonable attorneys’ fees) that the Power of Peace may suffer, pay or incur as a result of the Submission, use thereof by the Power of Peace or participant’s participation in the Contest.

10. APPLICABLE LAW: All federal, state, local, provincial and municipal laws and regulations apply. This contest is subject to the laws of the United States.
